A Harris County couple is suing over claims the husband sustained injuries as a result of tripping and falling at Home Depot.
Phong Pham and Mai Bui filed a lawsuit Feb. 25 in the Galveston Division of the Southern District of Texas against The Home Depot U.S.A. Inc., citing negligence and loss of companionship.
The plaintiffs claim on Nov. 10, 2012, Pham suffered injuries when an employee of Home Depot at 507 FM 2094 in Clear Lake, dropped a hoe on Pham's foot, causing him to fall and seriously injure his back, requiring multiple surgeries.
According to the brief, the defendant was negligent in failing to properly train their employees, failing to inspect the facility to prevent accidents and failing to provide their employees with the assistance needed for certain tasks.
The plaintiffs are seeking medical care expenses, loss of employment, damages, interest and court costs.
They are being represented in the case by Houston attorney Scott J. Davenport of Davenport Law Firm P.C.
