Clearwater doctor sues partner over wrongful garnishment claims

A doctor is suing over claims his business partner and a community bank led to wrongful garnishment.


Dr. Saeed A. Ally filed a lawsuit March 17 in the Jefferson County District Court against Dr. Otto Lawayne Miller and Community Bank of Texas NA. 

According to the complaint, on March 10, 2010, Dr. Ally took out a $289,000 commercial loan with Community Bank for his and Dr. Miller's company, SETX Clearwater Environmental.

In 2011, when Clearwater was struggling, Dr. Ally was in the middle of settling a case to prevent foreclosure when Dr. Miller misled and induced Community Bank to foreclose, injuring Dr. Ally's investment in the company and damaging his reputation with banks and creditors.

Dr. Ally claims the amount sought by Community Bank is incorrect.

Ally is seeking damages. He is being represented in the case by attorney K. Leigh Parker Jr.
