An industrial worker is suing an insurance company claiming it won’t pay him full benefits for an injury.
Jorge Figueroa filed a lawsuit March 14 in the Jefferson County District Court against Texas Mutual Insurance Co. for a judicial review of the workman’s compensation decision.
The lawsuit states Figueroa was injured Aug. 7, 2012, during his employment with Phoenix Industrial Service Co. Figueroa claims he severely injured his lower back while lifting a pump.
According to the suit, Figueroa's claim went through a benefit review conference and was considered at a contested case hearing on Nov. 5, 2013, where a hearing officer denied the claim.
The claim was appealed to the Texas Department of Insurance Division of Workers’ Compensation Appeals Panel, which affirmed the hearing officer’s order.
Figueroa is asking the court to reverse the decision so that he recovers both indemnity and medical benefits, plus general relief.
