Quality Roofing Services sued over trademark infringement

A California company is suing over claims a former employee committed trademark infringement.


Petersen-Dean Inc., filed a lawsuit March 20 in the Houston Division of the U.S. Court for the Southern District of Texas against Jason Brinkmann, doing business as Brinkmann Quality Roofing Services Inc., citing trademark infringement. 

According to the complaint, in 1971 Brinkmann's father started a roofing company called Brinkmann Investments Inc.

Petersen-Dean bought Brinkmann Investments in 2007, and hired Brinkmann with an agreement promising not to compete for five years after leaving the company.

Petersen-Dean says Brinkmann resigned on March 29, 2013, and up to a year before his resignation, he was preparing to conduct business under the Brinkmann name as a competitor, including buying relevant domains.

Brinkmann Quality Roofing is accused of trademark infringement, counterfeiting, domain name infringement and unfair competition.

Petersen-Dean is seeking a judicial decision preventing the defendant from conducting competing business as well as all court costs.

It is being represented in the case by attorneys John C. Cain and James H. Hall of Wong, Cabello, Lutsch, Rutherford & Brucculeri LLP.
