A Dallas County couple is suing an Ohio condominium owner, claiming breach of contract.
Thomas Leo Burke and Edeltraut Burke filed a lawsuit March 21 in the Galveston County District Court against Kevin Dahl, citing breach of contract.
The plaintiffs claim they entered into an agreement with the defendant on Jan. 16 to purchase a condominium at The Villas at Pointe West, in Galveston County.
According to the suit, Dahl was selling the property at a price insufficient to pay the entire balance of his mortgage loan, which requires the consent of the lien holder. The suit alleges Dahl has not performed the obligations stated in the contract by failing to get the lien holders consent in a timely manner, resulting in the plaintiffs needing to pay rent for the condominium longer than anticipated and requiring them to hire an attorney.
The plaintiffs are seeking a transfer of the property, damages, interest, attorney's fees and court costs.
They are being represented in the case by Galveston attorney Thomas W. McQuage.
