Aspen Healthcare dismissed from overtime wage suit

A Dallas area home health agency has been dismissed from a lawsuit filed by a former employee. 

As the Record previously reported, Jackie Jones filed a lawsuit Jan. 13 in the U.S. District Court for the Eastern District of Texas, Sherman Division, against Aspen Healthcare Services and Sukhu George, citing violations of the Fair Labor Standards Act. 

Jones dropped her suit, without prejudice, on April 3.

In her complaint, Jones worked for Aspen Healthcare from July 2012 through December 2013 as a certified nursing assistant. During at least one week of Jones' employment, she claims she worked more than 40 hours, but alleges the defendants failed to pay her overtime compensation in violation of the Fair Labor Standards Act, according to the original complaint.

Jones was seeking actual damages, compensatory damage, liquidated damages and costs.

She was being represented by Douglas B. Welmaker of Dunham & Jones PC in Austin.
