Cancer center sues another facility over patients

A cancer treatment center is suing a similar facility over exclusivity rights to patients.


The Cancer Treatment and Prevention Center filed a lawsuit May 13 the Jefferson County District Court against the Cancer Treatment Center of Southeast Texas, Dr. Joseph Kong, Dr. Ernest Hymel and Dr. Danny Chow, citing tortuous inference and negligence.



The lawsuit states the two had a contract that required the Southeast Texas facility to send all patients diagnosed with cancer or in need of radiation to the Cancer Treatment and Prevention Center.


Instead, the Cancer Treatment Center of Southeast Texas facility was diverting patients to its own center and misled patients about the contract with the facility and a right to see patients, the suit alleges.


The Cancer Treatment and Prevention Center is seeking a trial and wants to recover damages determined at trial with pre and post-judgment interest, court costs and any other relief deemed proper.


It is being represented by Gary M. Riebschlager of Brent Coon & Associates of Houston.
