Man files lawsuit against construction company after 20-foot fall

A man who claims he suffered a lacerated liver and fractured vertebrae after a 20-foot fall seeks monetary damages from a construction company.


Porfirio Torres filed a lawsuit July 24 in the Galveston County Court at Law No. 1 against Harbour Classic Builders and J. Castillo Construction. 


In his complaint, Torres alleges he was working for J. Castillo as a Harbour jobsite April 7 when he fell about 20 feet from scaffolding Harbour had built. Torres had not been provided with a safety harness and suffered numerous injuries because of the incident, including a lacerated liver, fractured vertebrae and a closed head injury, according to the complaint.


Torres blames the defendants for causing his injuries, saying they failed to build scaffolding, failed to properly instruct Torres, failed to supervise the work being done, failed to maintain a safe work environment and failed to provide proper safety equipment.


Torres seeks a judgment of more than $1 million, including compensatory damages, medical damages, lost earning capacity, mental anguish, exemplary damages, disfigurement, pre- and post-judgment interest, costs and other relief the court deems just.
