Two Beaumont residents say their replacement windows began to leak.
Arthur and Connie Berry filed a lawsuit July 21 in the Jefferson County District Court against Window World and Window World of Houston.
In their complaint, the Berrys allege they hired the defendants to replace all the windows in their home on Dowlen Place in Beaumont on March 7, 2009. The couple paid $15,429 for the installation, according to the complaint.
Soon after the windows were installed, they began leaking and caused damages to the home, the suit claims.
The Berrys allege negligence, fraudulent misrepresentation, negligent misrepresentation and breach of contract against the defendants.
The couple also accuses them of failing to comply with the Texas Deceptive Trade Practices Consumer Protection Act.
The Berrys seeks actual, treble, punitive and exemplary damages, plus attorneys’ fees, costs, pre- and post-judgment interest and other relief the court deems just.
They are being represented by attorneys Michael R. Ramsey and Sean M. Russell of Mostyn Law Firm in Beaumont.
