A man has filed suit against the driver he claims failed to stop at a red light and struck him in the middle of an intersection, causing the deaths of two of his passengers.
Patrick W. Collins, Nita C. Bailey and James W. Collins, as co-executors of the estates of Tom L. Collins and Juanita Collins, filed suit July 29 in the Galveston County District Court against Kenneth Turbeville and State Farm Mutual Automobile Insurance Co.
According to the complaint, Patrick was driving east on FM 1097 on Sept. 13, 2012, and was about to cross the intersection of Interstate 45 Access Road. Suddenly, defendant Turbeville collided with Patrick's vehicle, according to the complaint.
At the time of the collision, Tom L. Collins and Juanita Collins were riding in Patrick Collins's vehicle, the suit states.
Because of the accident, the plaintiffs suffered physical pain and mental anguish, endured physical impairment, lost their physical abilities, incurred medical costs and lost income, the suit states. Tom Collins and Juanita Collins died in the accident, the complaint says.
Turbeville negligently failed to stop at a red light, failed to control his speed, drove inattentively, failed to properly brake, failed to sound his horn, failed to take proper evasive action, failed to keep a proper lookout, drove recklessly and ran a red light, according to the complaint.
The plaintiffs seek unspecified damages, plus pre- and post-judgment interest, costs and other relief the court deems just.
They are being represented by attorney Mark D. Haas of Haas Law Firm in Conroe.
