Man files lawsuit against driver he claims struck vehicle in parking lot

A man has filed suit against the driver he claims struck his car in a parking lot.

Antonio Maldonado filed suit July 30 in the Galveston County District Court against Robert Smith. 

According to the complaint, the plaintiff was exiting a parking lot when the defendant reversed into the same parking lot and struck his car, causing a collision July 11.

Due to the collision, Maldonado incurred medical costs, lost earnings, experienced physical pain and suffering and endured mental anguish, according to the complaint. He also suffered impairment and disfigurement and lost his enjoyment of life, the suit states.

Smith negligently failed to drive safely, failed to keep a proper lookout and failed to keep a safe distance, the complaint says.

Maldonado is seeking punitive damages, plus pre- and post-judgment interest, costs and other relief the court deems just.

He will be represented by Michale E. Pierce and M. Paul Skrabanek of Pierce, Chapman, Skrabanek and Bruera in Houston.
