Insurance company refused to pay for medical costs, couple claims

Two Galveston County residents say they incurred medical costs of more than $50,000 following a collision.


Marco and Lino Gonzalez filed a lawsuit July 30 in the Galveston County District Court against Progressive County Mutual Insurance Co. 


In their complaint, the Gonzalezes allege Marco Gonzalez was driving in Texas City on Aug. 2, 2013, when a vehicle ran a red light and collided with his vehicle. At the time of the accident, Lino Gonzalez was riding as a passenger in the vehicle, according to the complaint.


Due to the accident, Lino Gonzalez incurred medical costs of more than $31,000 while Marco Gonzalez’s medical bills were more than $23,000, the suit states.


At the time of the collision, the Gonzalezes had an insurance policy through Progressive, which was supposed to provide coverage for under-insured motorist benefits, the suit states. However, Progressive has refused to pay their medical claims, the complaint says.


The Gonzalezes seek a judgment within the jurisdictional limits of the court, plus exemplary damages, pre-judgment interest at the maximum rate allowed by law, post-judgment interest at the legal rate, costs and other relief the court deems just.


They are being represented by attorney Carlos Garza of Martin, Garza and Fisher in Galveston.
