A Harris County resident has filed suit against Fuel Depot 19, saying she sustained injuries when she tripped on a drain cover.
Jenita Brantley filed July 30 in the Jefferson County District Court against Fuel Depot No. 19.
According to the complaint, Brantley was visiting Fuel Depot No. 19 at 700 Gulfway Drive in Port Arthur on May 22 with the intention to buy snacks. On her way to the cashier, Brantley stepped on a drain cover that was not flush with the ground, according to the complaint.
The drain cover moved and her foot went into the drain hole, causing her to fall to the ground, the suit states.
Due to her fall, Brantley experienced physical pain and suffering, endured mental anguish, incurred medical costs and suffered physical impairment, the complaint says. She also claims she lost wages.
Brantley blames the store for causing her fall saying employees failed to keep the area in a safe condition, failed to inspect the premises, failed to correct the condition and failed to inform her of the dangerous condition.
Brantley is seeking an unspecified judgment, plus pre- and post-judgment interest, punitive damages, costs and other relief the court deems just.
