Man files lawsuit against driver who rear-ended him

A man says he sustained personal injuries after a rear-end collision.


Dwayne Edward Ivy filed a lawsuit July 30 in the Galveston County District Court against Joseph Lewis. 


In his complaint, Ivy alleges he was driving north in the outside lane at 300 South Interstate Highway 45 in League City on Feb. 6, 2013, when Lewis, who was driving in the same direction behind Ivy, failed to control his speed and struck the back of Ivy’s vehicle.


Because of the collision, Ivy sustained serious personal injuries, endured mental anguish and physical pain and suffering and incurred medical costs, according to the complaint. He also lost his enjoyment of life and suffered from an impaired earning capacity, the suit states.


Ivy blames Lewis for causing the collision, saying he negligently drove too fast, drove in a careless and reckless manner, failed to apply his brakes in time to avoid a collision, failed to keep a proper lookout, failed to keep his vehicle under proper control and failed to fully pay attention to the road.


Ivy seeks punitive damages, plus pre- and post-judgment interest, costs and other relief the court deems just.


He is being represented by attorneys Frederick L. McGuire and Etta Davidson of the Law Office of Frederick L. McGuire in Liberty.
