Beaumont dance hall accused of negligence after alleged assault

A man is suing a Beaumont dance hall that he alleges failed to protect him from a physical attack. 

Daniel Brack filed the lawsuit against the Dixie Dance Hall, The Dixie Dance Hall Ltd. and Crockett Street Entertainment Inc. in Beaumont on Aug. 13 in Jefferson County District Court. 

Brack says he was at the Dixie Dance Hall in Beaumont on Dec. 28, 2013, when he was assaulted and seriously injured. He says it was a busy Friday night with about 150 people inside the establishment at the time of the alleged attack.

According to the complaint, Brack was approached by a man who hit him in the face, put him in a headlock and choked him. Brack says he screamed for help but no one responded. "He continued to fight to breathe, stay conscious and get away from the attacker" while bar employees watched but did not intervene, the lawsuit reads.  Brack says he was taken to a hospital where he underwent surgery to treat his injuries.

Brack says there was only one security staffer on duty the night he was allegedly attacked. He accuses the Dixie Dance Hall and its owners of negligence for failing to properly hire, supervise and train employees. He also accuses them of gross negligence for allegedly failing to ensure the facility was reasonably safe for patrons. 

Brack is asking for an unspecified amount of money to compensate for medical expenses, physical pain and suffering, mental anguish and loss of earnings. He also seeks punitive damages and court costs. 

Brack is represented by attorney John Pat Parsons of Lindsay, Lindsay & Parsons in Beaumont. They seek a jury trial.
