A man alleges he suffered physical pain and mental anguish after a driver sideswiped his vehicle.
John Anthony Kopecky filed a lawsuit Aug. 26 in Galveston County District Court against Morgan Nichole Fearrington and Robert A. Fearrington.
In his complaint, Kopecky alleges he was driving south on 69th Street and was trying to make a left-hand turn when defendant Morgan Nichole Fearrington, who was driving a vehicle owned by defendant Robert A. Fearrington, failed to pay attention in a turning lane. She sideswiped Kopecky's vehicle and failed to stop to help following the collision, according to the complaint.
Due to the accident, Kopecky incurred medical costs, the suit states.
He blames Morgan Nichole Fearrington for causing the collision, saying she negligently failed to keep a proper lookout, failed to yield the right-of-way, failed to keep an assured distance, failed to pay attention to surrounding vehicles and failed to timely apply her brakes, among other negligent acts, the complaint says.
Robert A. Fearrington is also named as a defendant for negligently entrusting the vehicle to Morgan Nichole Fearrington and for giving her permission to drive the vehicle, according to the complaint.
In his complaint, Kopecky seeks damages of no more than $100,000, plus pre- and post-judgment interest, costs and other relief the court deems just.
