Man says he lost finger while cutting meat for customer

Arnold kurt

A man has filed suit against his employer, alleging he lost his finger while working.

Cesar Davila claims he was working for defendant Food King at 915 Sixth St. N. in Texas City on April 1.  "While cutting meat for a customer, plaintiff used a meat cutter in a manner that was common practice at the Food King facility and sliced off his finger," the suit filed Aug. 28 in Galveston County District Court states.

Because of the incident, Davila incurred medical costs, lost his earning capacity, experienced pain and suffering and suffered mental anguish, the complaint says.

Davila accuses Food King of negligence, saying it negligently failed to properly train its employees, failed to provide a safe work environment and failed to establish proper safety protocols.

Kurt B. Arnold and Sarah Scott of Arnold & Itkin in Houston will be representing him.
