A man claims he suffered injuries when a driver switched lanes and caused his moped to flip.
Paul Magee filed a lawsuit Sept. 5 in Jefferson County District Court against Barry Lynn Frasier.
In his complaint, Magee claims he was driving in the Parkdale Mall's parking lot on Sept. 7, 2012. He was driving in the right lane while Frasier was driving in the left lane, according to the complaint.
"As plaintiff was moving past defendant's truck, defendant made a right hand turn from the left lane and struck the rear of plaintiff's moped, causing the moped to flip over," the suit states.
Because of the collision, Magee incurred medical costs, experienced physical pain and suffering and endured physical impairment, the complaint says. He also endured mental anguish, he claims.
Magee blames Frasier for causing the collision, saying he negligently failed to keep a proper lookout, failed to yield the right-of-way, failed to timely apply his brakes, made an improper right turn and turned into another lane when it was not safe to do so.
In his complaint, Magee seeks a judgment in excess of the minimum jurisdictional limits of the court, plus pre- and post-judgment interest, costs and other relief the court deems just.
