A man has filed suit against his insurance company, seeking repayment for injuries he allegedly sustained in a multi-car collision.
Jimmy R. Valsin alleges he was driving on state Highway 69 in Beaumont on Sept. 29, 2012, when defendant Brittney Renee Vasquez lost control of the vehicle she was driving and struck another vehicle, disabling it on the road. In turn, Valsin struck the disabled vehicle and was rear-ended, according to the complaint filed Sept. 8 in Jefferson County District Court.
At the time of the collision, Vasquez was driving a vehicle owned by defendant Edder Espinoza. The vehicle was uninsured, the suit states.
Following the accident, Valsin sought damages from his insurance company, defendant Farmers Texas County Mutual Insurance Co., which was supposed to provide protection in the event of a collision with an uninsured driver, the complaint says. However, the insurance company has failed to remit payment, he alleges.
Due to the collision, Valsin suffered extreme physical pain, suffering and mental anguish, and endured physical impairment, according to the complaint.
He blames Vasquez for causing the collision, saying she negligently failed to control her speed, failed to keep a proper lookout, failed to keep proper control of her vehicle and failed to keep her vehicle in good working condition.
Espinoza negligently allowed Vasquez to drive when she was not competent to do so, failed to maintain insurance on his vehicle, allowed Vasquez to drive a vehicle when it was not insured and negligently entrusted Vasquez to operate his vehicle, the suit states.
In his complaint, Valsin seeks a judgment in excess of the minimum jurisdictional limits of the court, plus costs, attorney fees, treble damages, pre- and post-judgment interest and other relief the court deems just.
