Man alleges injuries in rear-end collision at red light

A man alleges he suffered physical pain and mental anguish after a driver rear-ended his vehicle at a stoplight.

Jamie Yeager filed a lawsuit Sept. 8 in Galveston County District Court against Aaron Tolbert and Royetta Toliver. 

In his complaint, Yeager alleges he was driving west in the 1000 block of Ninth Avenue North in Texas City on Sept. 13, 2013, when he stopped at a red light at its intersection with 10th Street.

Suddenly, Royetta Toliver, who was driving behind Yeager, failed to apply her brakes and struck his vehicle, according to the complaint.

In addition to his physical pain and mental anguish, Yeager endured disfigurement, suffered impairment and incurred medical costs, the suit states. He also lost his earning capacity, the complaint says.

Yeager blames Royetta Tolbert for causing the collision, saying she negligently failed to control the speed of her vehicle, failed to control the operation of the vehicle, failed to avoid the accident, failed to keep a proper lookout, failed to properly apply her brakes and failed to drive as a reasonable person would have.

In addition to Royetta Tolbert, Yeager names Aaron Tolbert as a defendant, saying he negligently entrusted his vehicle to an unlicensed, incompetent or reckless driver.

In his complaint, Yeager seeks an unspecified judgment, plus costs, interest and other relief the court deems just.
