A woman says she experienced pain and suffering when a driver allegedly turned into her vehicle, causing a collision.
Yazmin Garay filed a lawsuit Sept. 18 in Galveston County District Court against Tara Hart.
In her complaint, Garay alleges she was making a left-hand turn onto West Wilkins Street from the median of state Highway 3 on Dec. 31, 2012, when Hart attempted to make a right-hand turn from West Wilkins onto Highway 3, causing a collision.
Because of the collision, Garay suffered pain and mental anguish, incurred medical costs and lost her earning capacity, according to the complaint. She also suffered impairment and disfigurement, lost her enjoyment of life and incurred a diminished property value, the suit states.
Garay blames Hart for causing the collision, saying she negligently failed to control her speed, failed to drive with the precaution of an ordinary motorist, failed to maintain a proper lookout, failed to timely apply her brakes and failed to pay attention to her surroundings.
In her complaint, Garay seeks actual damages, plus pre- and post-judgment interest at the maximum rate allowed by law and other relief the court deems just.
