A Galveston resident filed a lawsuit against a dentist alleging professional negligence in her 2013 treatment.
Rebekah Faircloth filed a complaint against Dr. Charles Scruggs, d/b/a Dr. Charles Scruggs P.C., and Gulf Coast Oral & Maxillofacial Surgery of Texas City in Galveston County District Court on July 1, claiming liability in September 2013 when planned surgical removal of impacted wisdom teeth allegedly resulted in permanent injuries to the plaintiff.
According to the suit, Scruggs performed oral surgery on Faircloth between Sept. 5 and Sept. 20, 2013. The complaint states that the practitioner extracted the plaintiff’s adult molar tooth instead of a designated wisdom tooth. Consequently, the plaintiff avers, long-term medical treatment was necessary, including surgery to install a dental implant as a result of the dentist’s alleged negligent extraction.
Faircloth alleges that the doctor was in breach of duty of ordinary care and skill when he failed to properly perform the necessary medical treatment, instead performing “needless and unnecessary” tooth extraction on the plaintiff.
Claiming pain and suffering, mental anguish, medical expenses, loss of body member, impairment, disfigurement and fear of future disease, the plaintiff seeks compensation for exemplary damages, pre- and post-judgment interest, attorney’s fees, expenses, and costs.
