Crispy potato surprise at IHOP results in lawsuit

Vidor local Stephen Brady wanted his potatoes served crisped, but not so crisp he’d crack a tooth after taking a bite.

Alleging he spit out a piece of plate after scooping in a mouth full of potatoes at IHOP, Brady filed suit against the restaurant’s owner, Bona 1900, on July 9 in Jefferson County District Court.

According to the lawsuit, on Aug. 10, 2014, Brady was eating at a Beaumont IHOP when he was served a meal that left him in need of a dentist afterward.

“Brady ordered breakfast, which included crispy potatoes,” the suit states. “When his order was delivered, he bit into the potatoes, hit something hard, and spit out a piece of plate. He checked his teeth and found that a piece of on tooth was missing.”

The IHOP franchise is accused of negligently failing to prepare the meal and failing to note the food was tainted.

Seeking no more than $200,000 in damages, Brady is suing for his physical pain, mental anguish, medical expenses, impairment, disfigurement and lost wages.

Attorney Hart Green of Weller, Green Toups & Terrell represents him.

Judge Kent Walston, 58th District Court, has been assigned to the case.
