Motorist couple litigates against driver over failure to yield right of way

A Jefferson County couple filed a lawsuit against a Liberty County resident alleging negligence in a 2014 traffic accident which they claim left them with serious injuries.

Patrice Leday and Albert Saunders filed a complaint against Winnefred Jackson of Dayton in Jefferson County District Court on July 6, claiming liability in a November 2014 intersection collision.

According to the suit, the pair was traveling north in the 2500 block of Avenue C in Beaumont on Nov. 8, 2014, with Saunders in the driver’s seat. The suit states that the defendant was stopped at the intersection of Avenue C and Corley Avenue; when the plaintiffs proceeded through the intersection, Jackson allegedly failed to yield the right of way and struck the plaintiffs’ vehicle broadside on the passenger side.

The complaint states that Leday was taken to a hospital via ambulance for treatment, and that Jackson was issued a citation for failing to yield the right of way.

The plaintiffs allege negligence, including but not limited to failing to operate her vehicle safely, maintain a proper lookout, control her speed, apply her brakes, and take evasive action in time to avoid a collision.

Leday and Saunders request compensation for medical bills, mental anguish, physical pain, suffering and impairment, loss of enjoyment of life, and loss of earning capacity.

Seeking between $100,000 and $200,000 for damages, interest, attorney’s fees, expenses, and costs, the plaintiffs are represented by Malachi Daws of The Daws Law Firm in Beaumont.
