Insured driver sues Allstate, claiming unsatisfactory collision reimbursement

A Jefferson County resident is suing her insurance company alleging breach of contract based on her 2013 motor vehicle-related claim.

Jeanne Morris Hines filed a complaint against Allstate Indemnity Co. of Dallas in Jefferson County District Court on July 10, claiming liability in a collision with a third party which she maintains caused bodily injury and property damage.

According to the suit, Hines suffered injuries on Sept. 6, 2013, as a result of a motor vehicle accident in Jefferson County. The lawsuit states that the plaintiff was stopped at the intersection of Main Avenue and 12th Street when a vehicle driven by Rebecca Veazey made an improper left turn struck her automobile.

The plaintiff contends that she suffered pain and impairment, and that Allstate is required to compensate her for medical expenses. The suit states that Veazey was uninsured and/or underinsured; Hines avers that her policy covers the situation, that all conditions have been performed or have occurred, and that Allstate has refused to pay reasonable benefits to her despite her written demands.

Stating that she is unable to calculate the exact monetary damage, Hines seeks an amount of more than $1 million, or alternatively an amount between $200,000 and $1 million, between $100,000 and $200,000, or $100,000 or less, along with pre- and post-judgment interest, attorney’s fees, expenses, and costs.
