Bus passenger hits the ceiling, sues for damages

A bus passenger filed a lawsuit against a Beaumont business and a Florida company doing business in Texas on charges of vehicular negligence when a bumpy ride allegedly injured him in 2013.

David Dupre filed a lawsuit against Beaumont Transit Company and CCL Management Inc. of Jacksonville, Fla., in Jefferson County District Court on July 21, claiming liability in a November 2013 accident which the plaintiff asserts caused him severe and permanent injuries when he was a passenger aboard a bus belonging to and operated by the defendants.

According to the lawsuit, on or about Nov. 2, 2013, a Beaumont Municipal Transit bus was traveling on Seventh Avenue when it hit a large pot hole, allegedly causing the plaintiff to hit the roof of the bus interior and land on the floor.

The complaint states that the defendants were in breach of duty when the operator failed to brake, keep a lookout, drive safely, control the bus, keep a safe distance and avoid the pothole, and control the vehicle’s speed.

Dupre alleges injuries to his head, chest, back, hip, right leg and general body. Claiming pain, suffering, anguish, lost earning capacity, impairment and medical expenses, the plaintiff seeks general and special compensation for damages, interest, attorney’s fees, expenses, and costs. The plaintiff is represented by Tom Oxford of Waldman Smallwood in Beaumont.
