Houston excavation business taken to court

A Galveston County utility operation is suing a Houston excavation company, alleging damage to an underground cable.

GTE Southwest Incorporated, doing business as Verizon Southwest, filed a lawsuit June 10 in the Galveston County District Court against Houston-based Bynum Enterprises Inc., doing business as Able Paving and Performance Contracting Inc., alleging trespassing and negligence.

According to the complaint, on June 12, 2013, Able Paving engaged in excavation activities at a site near state Highway 146 in Bacliff and during the course of excavation, the defendants struck and damaged Verizon Southwest's underground fiber optic telecommunications cable and conduit facilities.

GTE Southwest seeks damages of $12,551.23 and court costs. It is represented by attorney David Redford of Brown Sims in Houston.
