Ricky Johnson sues apartment complex, alleging negligence after railing gives way

A Jefferson County man is suing a Beaumont apartment complex after sustaining injuries when he says a railing on a second story balcony gave way.

Ricky Darrell Johnson filed a lawsuit Aug. 4 in the Jefferson County District Court against Timberlake Courts Management and Timberlake Courts Associates, doing business as Timberlake Court Apartments, alleging negligence.

According to the complaint, on Nov. 20, 2013, Johnson and two other apartment tenants were on a second story walkway/common area and when Johnson leaned on a protective railing it gave way, resulting in a fall of approximately 12 feet. The suit says Johnson landed on concrete and was unconscious. Upon waking, the lawsuit states, he could not feel his legs and he was taken to the hospital by ambulance.

The suit says Johnson suffered physical and mental anguish, disfigurement, physical impairment and lost wages.

The plaintiff alleges negligence, including not maintaining the premises, failure to warn of a dangerous condition and failure to correct a dangerous condition.

Johnson seeks monetary relief of more than $100,000 and pre- and post-judgment interest, plus attorney fees and court costs. He is represented by attorney William H. Conley of Beaumont.
