An Angelina County couple is suing an Oklahoma trucking firm and two of its principals, alleging roadway negligence in an accident.
Tammy Peeler and her husband Devin Peeler filed a lawsuit Aug. 12 in the Marshall Division of the Eastern District of Texas against Bobby Joe Gilley Jr. and Marcus D. Standifer, individually and doing business as Standifer’s Trucking of Warner, Okla., alleging negligence in a 2013 accident.
According to the lawsuit, on Dec. 12, 2013, Tammy Peeler was driving her 2003 Chevrolet Trailblazer westbound on Ellen Trout Drive in Lufkin when Gilley, operating a 1999 Kenworth trailer-tractor truck combination, exited from a warehouse onto Ellen Trout Drive without yielding right of way to the plaintiff. The suit says Peeler maneuvered her vehicle off the roadway in order to avoid a collision and struck a sign at Ellen Trout Zoo, sustaining neck, shoulder and back injuries.
The lawsuit charges the defendants with reckless driving and failure to yield the right of way, brake properly, keep a safe distance from other vehicles and maintain a sufficient lookout. The plaintiffs hold all parties responsible for damages as Gilley was an employee of Standifer’s.
Tammy Peeler alleges pain, suffering, anguish, impairment, disfigurement, medical bills, and lost earnings as a result of the accident. Devin Peeler alleges loss of consortium, care, support and services from his injured wife.
The Peelers seek more than $75,000 in compensation for damages, pre-judgment interest, attorney fees, expenses and costs. They are represented by attorney Jeff Badders of the Badders Law Firm in Nacogdoches.
