3 Texas workers sue MAPP Construction, alleging unpaid overtime

Three Texas residents are suing their former employer, a construction company, alleging unpaid overtime wages.

Salvador Reyes, Jorge Guillen, and Elin Javier Zelaya Funez, individually and for all others similarly situated, filed a collective action lawsuit Aug. 12 in the Houston Division of the Southern District of Texas against MAPP Construction and JC Works Construction Solutions, alleging failure to pay overtime wages owed as defined by the Fair Labor Standards Act.

According to the complaint, the plaintiffs performed work including painting and finishing walls, ceilings, doors and windows for the defendant. The suit says MAPP Construction paid straight time for all hours the plaintiffs worked, even though they regularly worked 60 hours or more per week, in violation of the required overtime premium for hours worked beyond 40 hours per week.

The plaintiffs seek to recover unpaid overtime compensation, liquidated damages and attorney fees. They are represented by attorney Josef F. Buenker of Houston.
