A Louisiana husband and wife are suing a transportation company and one of its truck drivers, alleging negligence in a vehicle collision.

Tu Van Pham and Nu Thi Do, of Avondale, filed a lawsuit Aug. 15 in the Tyler Division of the Eastern District of Texas against Gabriel Alvaro Zicari Nunoz, JMC Transports and JMC Logistics Solutions, alleging negligence.

According to the complaint, on Aug. 15, 2013, the couple was driving west on Interstate Highway 20 toward Dallas to visit their children when their car was struck by a tractor trailer driven by Zicari Munoz and owned/leased by JMC Transports and JMC Logistics Solutions.

The suit says Zicari Munoz suddenly changed lanes, striking the couple's car and forcing it off the road and into a center median wall. The suit alleges Zicari Munoz continued along the interstate until contacted by a witness to the accident.

The suit states Do and Pham, who were both wearing seat belts, suffered serious physical injuries and loss of employment, and the car was a total loss, as a result of the accident.

The plaintiffs seek damages and court costs. They are represented by attorneys David D. Davis of Grand Prairie, and Barbara Cole of The Cole Law Firm in Dallas.

Tyler Division of the Eastern District of Texas case number 6:15-cv-00778-MHS.
