ACE Insurance sues clients

Contract

An insurance company is suing a group of clients, alleging it should not be held responsible for defending the group as part of a separate lawsuit.

ACE American Insurance Company and ACE Property & Casualty Insurance Company filed a lawsuit Aug. 19 in the Houston Division of the Southern District of Texas against Magnum Hunter Resources Corp., TransTex Hunter, Triad Hunter and Eureka Hunter Pipeline.

According to the complaint, the defendants were previously sued in Ohio Circuit Court in West Virginia, over allegations of negligence and sought coverage under a policy with the plaintiffs of this suit. However, the suit alleges the plaintiffs of this suit are under no obligation to defend or indemnify the defendants in the separate legal action.

ACE American Insurance and ACE Property & Casualty seek a judgment declaring they have no duty to defend or indemnify the defendants. They are represented by attorneys Kent M. Adams and Sarah R. Smith of Lews Brisbois Bisgaard & Smith in Houston.
