Roofing business accuses McLean Insurance of unfair practices

GALVESTON -- A Texas roofing business is suing an insurance firm, alleging negligence and unfair insurance practices. 

Integrity Roofing and Painting LLC filed a lawsuit Sept. 18 in Galveston County District Court against Charlotte Hood McLean, individually and doing business as McLean Insurance Group, and Texas Mutual Insurance Company.

According to the complaint, Integrity entered into a business arrangement with the defendant, who was responsible for advising, obtaining, procuring, brokering, managing, negotiating, placement and management of insurance coverage and policies. As such, the suit says, the plaintiff made premium payments for worker's compensation coverage. 

On Aug. 20, 2014, an Integrity employee suffered an injury at work, the lawsuit states, but McLean Insurance denied coverage. 

The plaintiff alleges negligence, breach of fiduciary relationship, fraud, breach of contract, deceptive trade practices, and bad faith insurance practices.

Integrity Roofing and Painting seeks damages, attorney fees and court costs. It is represented by attorneys Lawrence M. Tylka of Tylka Law Center PC in League City, and Christian C. Samuelson of The Samuelson Law Firm in Houston.
