An Ohio motorist is suing a Center trucking company, its owner and one of its employees, alleging negligence for severe injuries the plaintiff says he sustained in a vehicle collision.
Jama Mohamud filed a lawsuit Aug. 31 in the Lufkin Division of the Eastern District of Texas against Benito Caballero-Sanchez of Shelby County, Nicolas Santana and Nicolas Trucking, alleging negligence.
According to the complaint, on Nov. 22, 2013, Mohamud was driving northbound on U.S. Highway 59 in Shelby County when Caballero-Sanchez, who was traveling southbound in a tractor-trailer owned by Santana and Nicolas Trucking, crossed into the northbound lane and crashed into Mohamud's vehicle.
The suit faults Caballero-Sanchez with failing to maintain a proper lookout, not driving in the appropriate lane of traffic, crossing a divided highway lane into oncoming traffic, making an unsafe turn, and driving both inattentively and recklessly. The lawsuit states Santana and Nicolas Trucking are also responsible for causing the accident as Caballero-Sanchez was acting within the course and scope of his employment for Santana and Nicolas Trucking.
The lawsuit alleges Santana and Nicolas Trucking were negligent in entrusting Caballero-Sanchez with the tractor-trailer as they should have been aware that he was a reckless and incompetent driver.
The suit states the plaintiff has and will continue to endure physical pain, mental anguish, disfigurement, physical impairment, medical expenses, lost wages and loss of earning capacity.
Mohamud seeks compensation for damages, in addition to cost courts and other relief deemed appropriate by the court. He is represented by attorneys Michael A.
