Plaintiff seeks summary judgment in $1M suit against Groves Equipment Rental

A man who sued a driver and an equipment rental company after a collision with a truck has moved for summary judgment.

Robert J. and Barbara Simon filed a lawsuit March 12, 2014, in the Jefferson County District Court against Ethan Kirk Blood and Groves Equipment Rental, citing negligence.

On Oct. 13 Robert Simon filed a motion for summary judgment, stating there is no evidence to support the defendants’ claims that the incident was caused by a third party or by Robert Simon.

The lawsuit states Robert Simon was stopped in traffic when Ethan Kirk Blood struck the Simons’ vehicle from the rear with a large, heavy-duty truck owned by Groves Equipment Rental.

The couple sustained serious and permanent injuries, according to the complaint.

The Simons are suing for damages in excess of $1 million.

They are being represented by Sutton & Jacobs LLP.

The defendants are represented by J. Diamond and Associates.
