Couple seeks damages after alleged injuries in landfill accident

MARSHALL – A husband and wife are suing a local landfill after the husband was allegedly injured in an accident.

Terry and Stephanie Shelton filed a lawsuit Feb. 3 in the Marshall Division of the Eastern District of Texas against Greenwood Landfill TX LP, citing negligence.

According to the complaint, on or about Jan. 16, 2015, Shelton was operating a dump truck at a Smith County landfill while working for the East Texas Mud Municipal Utility District when a Caterpillar bulldozer, which was being operated by a landfill employee, collided with Shelton’s truck. As a result of the accident, Shelton suffered permanent and disabling injuries, the suit states.

Shelton is demanding a jury trial, damages for his pain and mental anguish, physical and mental impairment, disfigurement, loss of wages and earning capacity, and payments for care and rehabilitation. Jimmy M. Negem and Joe M. Worthington of Negem and Worthington in Tyler will represent the plaintiffs.
