HOUSTON – A Chinese minerals supplier based in Houston is suing a Washington state trucking company, alleging breach of contract.
Xinyang Hualong Minerals Co., Ltd. filed a lawsuit Jan. 13 in the Houston Division of the Southern District of Texas against John Delgado of Belleville, Washington, doing business as PetroFrac Global Logistics, alleging breach of contract and unjust enrichment from a transportation agreement.
According to the complaint, Xinyang Hualong Minerals and PetroFrac entered a transportation agreement Jan. 27, 2015, then amended April 3, 2015, with Xinyang Hualong performing its obligations and making payments totaling $2,2 million.
The suit says Delgado managed the transportation of 13,200 metric tons of product, but refused and failed to transport the rest of the cargo of 1,800 metric tons of product. Delgado, according to the lawsuit, also failed to pay various fees to the port of Vancouver related to the product.
Xinyang Hualong Minerals seeks monetary damages as well as reasonable and necessary attorney fees and pre- and post-judgment interest at the maximum rate permitted by law. It is represented by attorneys Jeffery Johnson and Brett Solberg of DLA Piper LLP in Houston.
