BEAUMONT – A former salesman is suing a Jasper biochemical company, alleging breach of contract.
J. William Breen filed a lawsuit Jan. 11 in the Beaumont Division of the Eastern District of Texas against Terra Biochem LLC ,alleging breach of contract.
On Dec. 4, 2013, according to the lawsuit, Terra and JWBI entered into a letter agreement that Terra would pay him a commission on sales Terra makes to certain customers to whom JWBI represents in sales negotiations.
In 2015, the suit says, Terra experienced financial difficulties and failed to timely pay commissions to JWBI, adding that Terra acknowledged repeatedly its obligation to pay commissions in written correspondence. The lawsuit alleges Terra has still not paid JWBI any of the commissions for 2015.
Breen seeks $194,987.60 in owed commissions, plus attorney fees. He is represented by attorneys Allen Rustay and Jay Gross of Hicks Thomas LLP in Houston.
