Crane operators sue former employers for allegedly unpaid overtime

HOUSTON – Two Texas men are suing their former employer over allegations that they were not paid overtime.

John Milam and Christopher Dorsett filed a complaint on Feb. 16 in the Houston Division of the Southern District of Texas against Superior Energy Services LLC, doing business as SPC Rentals, and Warrior Energy Services Corp., citing violation of the Fair Labor Standards Act.

According to the complaint, the plaintiffs allege that they were employed by the defendants as crane operator and field supervisor. The plaintiffs hold the defendants responsible because they allegedly did not pay overtime wage for the weeks Milam and Dorsett worked more than 40 hours, and that they had been misclassified as being exempt from overtime wages.

The plaintiffs seek the following: compensation for the actual damages of the unpaid overtime pay and all other damages and legal fees. They are represented by Edwin Sullivan of Oberti Sullivan LLP in Houston.
