Tow truck driver accuses employer of not paying overtime wages

HOUSTON – A Harris County business faces a lawsuit from a former employee over allegations of unpaid wages.

Shaun Kieselhorst filed a complaint on Feb. 16 in the Houston Division for the Southern District of Texas against Makansam Inc. and Khalid Abushaaban, citing violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that between 2005 and April 2014, he was employed as a tow truck driver on a commission basis and worked hours on average of 72 per week. The plaintiff holds the defendants responsible because they allegedly deducted incorrect amounts for fuel and other charges from the gross pay of Kieselhorst and refused to pay overtime wages.

The plaintiff seeks the following: compensation for unpaid overtime pay and back wages and all other recoverable costs and fees. He is represented by Thomas H. Padgett Jr., Charles L. Scalise and Daniel B. Ross of the Ross Law Group in Bellaire.
