HOUSTON – A Houston engineering company is suing Samsung in an effort to collect more than $2.8 million in contractual repair fees.
Trelleborg Offshore US, Inc. filed a lawsuit Feb. 22 in the Houston Division of the Southern District of Texas against Samsung Heavy Industries, Co. alleging breach of contract.
Pursuant to January 2012 agreement Trelleborg alleges it supplied Samsung with a series of modules designed to help stabilize the weight of sub-sea drilling equipment. In October 2014, the suit says, Samsung discovered the modules had been damaged.
The two began negotiations and entered into two service agreements. Trelleborg said it completed both repair-projects in accordance with the agreements but Samsung has failed to make any of the payments due the plaintiff, under the two agreements.
Trelleborg Offshore seeks $2,865,907.87 in unpaid repair fees, together with accrued and unpaid interest at a rate of 1.5 percent per month from 30 days of each unpaid invoice, as well as reasonable and necessary attorney fees and costs.
