Motorist blames Schneider National Carriers, driver for accident, injuries

MARSHALL – A motorist is suing a national trucking company, alleging gross negligence after she says one of the defendant's big rigs drove through a red light and struck her car.

Kayla Davis filed a lawsuit Feb. 17 in the Marshall Division of Eastern District of Texas against Schneider National Carriers Inc. and Victoria Sheriece Moorer, alleging gross negligence.

On Feb. 19, 2014, according to the complaint, Davis was driving a 2007 Kia Spectra westbound on U.S. Highway 80 in Harrison County when she was struck by a 2011 Freightliner truck owned by Schneider National Carriers and driven by Moorer, who ran a red light. The lawsuit states Davis suffered serious injuries.  

The suit says Moorer was negligent in failing to stop and yield the intersection, failing to apply brakes, failing to keep a proper lookout and failing to slow down. The lawsuit alleges Schneider entrusted one of its trucks to an unlicensed and incompetent driver.

Davis seeks actual damages, post-judgment interest as allowed by federal law, court costs, fees and other expenses, plus a jury trial. She is represented by attorney Brent Goudarzi of Goudarzi and Young LLP of Gilmore, and attorney George A. Otstott of Otstott and Jamison PC of Dallas.
