Mechanic alleges Cat5 Resources failed to pay overtime wages

BEAUMONT – A Texas man is suing a Jefferson County telecommunications engineering company, alleging not paying overtime compensation.

Matthew Jones filed a lawsuit Feb. 18 in the Beaumont Division of the Eastern District of Texas against Cat5 Resources LLC, alleging violation of the Fair Labor Standards Act.

According to the complaint, from April 2014 to the present, Jones worked for Cat5 as a mechanic, where the pay practice was to pay only a set amount to Jones for each pay period, regardless of whether he worked more than 40 hours per week. When Jones did work more than 50 hours per week, according to the suit, did he get paid overtime, under the guise of ``bonus hours.”

The suit alleges the overtime calculations were based only on hours in excess of 50 hours per week, instead of the 40-hour/week calculation framework under the Fair Labor Standards Act.

Jones seeks wages not properly paid to him, liquidated damages, attorney fees, expert fees and pre- and post-judgment interest on all damage, plus court costs. He is represented by attorney John Werner of Reaud, Morgan & Quinn LLP in Beaumont.
