United Parcel Service sued for alleged Americans with Disabilities Act violation

HOUSTON — A business manager is suing United Parcel Service, a logistics company, citing alleged failure to uphold Americans with Disabilities Act regulations, retaliation and violation of the Family and Medical Leave Act.

Kurt Fahrenthold filed a complaint on March 9 in the U.S. District Court for the Southern District of Texas Houston Division against United Parcel Service Incorporated, alleging that the logistics company intentionally violated the Family and Medical Leave Act and the Americans with Disabilities Act.

According to the complaint, the plaintiff alleges that he took medical leave on Sept. 16, 2013. He alleges that he was cleared to return a year later, but was told there was no work. According to the complaint, after Fahrenthold filed a discrimination suit, he was demoted due to a misconduct of a subordinate from before he went on medical leave, was reassigned to the night shift and suffered loss of pay and benefits, humiliation, mental anguish and emotional distress. The plaintiff holds United Parcel Service responsible because the defendant allegedly discriminated against him on the grounds of his disability, demoted him, denied him reasonable accommodation and denied him employment and promotional opportunities.

The plaintiff seeks compensation for all damages and all legal fees, an order enjoining the defendant from further violating the federal laws, and all other relief that he is entitled to under law and equity. He is represented by LaShawn A. Williams of L.A. Williams Law Firm P.C. in Houston.
