HOUSTON — An employee is suing a Harris County company, alleging unpaid wages and violation of workers compensation acts.
Marcus L. Mays, individually and on behalf of all others similarly situated, filed a lawsuit March 22 in the Houston Division of the Southern District of Texas against ACS Commercial Services alleging it refused to provide drive time pay to its employees as well as overtime wage.
According to the complaint, Mays worked for more than 40 hours per week but did not receive any overtime pay or drive time pay when the plaintiff needed to drive to the project site. Mays alleges the defendant failed to fairly compensate employees by paying travel time which also affected workers' overtime pay.
Mays seeks a trial by jury, declaratory and injunctive relief, award all unpaid overtime wages, liquidated damages plus interest, all legal fees and any other relief the court deems just.
