Employee accuses energy business of failing to pay overtime

HOUSTON — A Texas man is suing an energy company, alleging failure to pay overtime. 

Adam Tiner filed a lawsuit, individually and on behalf of all others similarly situated, on April 1 in the Houston Division of the Southern District of Texas against Complete Energy Services Inc., doing business as a Superior Fluid Management Inc., and Superior Energy Services Inc., alleging they failed to pay overtime wages to employees.

According to the complaint, Tiner worked for more than 40 hours per week but did not receive any overtime pay for the extra hours. The plaintiff alleges the defendants improperly excluded these non-discretionary bonuses from their employees' regular pay rate which resulted in Tiner not being paid overtime.

Tiner requests a trial by jury, unpaid overtime compensation, an amount equal to the overtime wages as liquidated damages, interest, all legal fees and any other relief as the court deems just.
