Employees allege nursing facility failed to pay overtime

HOUSTON — Two employees are suing a Woodlands nursing home, alleging it failed to pay overtime wages.

Maria Abeldano and Jeanine Pollion filed a lawsuit, individually and on behalf of all others similarly situated, April 20 in the Houston Division of the Southern District of Texas against HMG Park Manor of Westchase LLC, doing business as Park Manor of Westchase, in the Woodlands alleging violation of the Fair Labor Standards Act in failing to to fairly compensate employees.

According to the complaint, from April 20, 2013 to the present, Abeldano and Pollion worked more than 40 hours per week but were not paid any overtime wages. The plaintiffs allege the defendant failed to pay overtime or to clock the work of their employees.

Abeldano and Pollion seek a trial by jury, all unpaid wages, liquidated damages equal to the unpaid wages, interest, all legal fees and any other relief the court deems just. They are represented by attorney David G. Langenfeld of Leichter Law Firm PC in Austin.
