HOUSTON — An organization and a disabled man is suing a Houston facility operator, alleging failure to provide proper access for the disabled.
Don’t Dismyabilities Inc. and Ronald Roberson filed a lawsuit June 30 in the Houston Division of the Southern District of Texas against New Richfountain Properties, Inc. and Prospect Park, Ltd., alleging failure to uphold Americans with Disabilities Act regulations by failing to provide full and equal use or access to the goods, services and accommodations available at the property.
According to the complaint, Roberson has visited the defendants' facility 3100 Fountain Drive, Houston, and encountered architectural barriers, including inaccessible parking and no accessible route to, into or throughout the facility.
The plaintiffs allege the defendants denied Roberson appropriate and dignified access into their property, failed to remove those barriers when the removal was readily achievable and failed to provide the correct accessible parking and the correct accessible routes to the public accommodation.
Roberson and Don't Dismyabilities seek a trial by jury, an order directing the defendants to remove the architectural barriers barring disabled persons from the full and equal access to their facilities, monetary judgment, attorney fees, expenses, legal costs and all other relief the court deems appropriate.
