HOUSTON — A Houston man is suing a charter school, alleging constant telephone harassment.
Joseph Harrison filed a lawsuit July 11 in the U.S. District Court for the Southern District of Texas against Tekoa Charter School, Inc., doing business as Tekoa Academy, alleging the school violated the Telephone Consumer Protection Act.
According to the complaint, between April 22-May 24, 2016, Harrison received several computer generated calls to his cellular telephone and continued to receive calls after he revoked any consent that may previously have been given to defendant. The suit says Harrison has been damaged, harassed and abused by all the calls, including those that came as early as 5:50 a.m.
The plaintiff alleges Tekoa Academy called his cellular telephone through the use of an automatic telephone dialing system without his prior express consent.
The plaintiff seeks trial by jury, an order enjoining the defendant from placing any further calls to his cellular phone, award for actual, treble and statutory damages of $500 per phone call, attorney fees and legal costs, pre- and post-judgment interest and other relief the court deems just and proper.
