Garbage truck driver alleges waste hauling company owes overtime payments

HOUSTON — A Harris County man is suing a waste hauling company, alleging violation of workers compensation acts in failing to pay overtime.

Edward Brown filed a lawsuit July 11 in the Houston Division of the Southern District of Texas against Karen Counts and Aggressive Waste Disposal Inc., alleging violations of the Fair Labor Standards Act.

According to the complaint, Brown has been working an average of more than 40 hours per week for Aggressive Waste since September 2013, without receiving overtime pay for all hours he has worked in excess of 40 hours a week. 

The plaintiff alleges the defendants failed to pay an overtime premium at the rate of one and one-half times Brown's regular rate of pay for all hours worked in excess of 40 hours per week as required by FLSA and that Aggressive Waste failed to maintain a complete, accurate and contemporaneous time and pay records.

Brown seeks a trial by jury, declaration the defendants have violated FLSA, all unpaid overtime wages, an additional equal amount as liquidated damages, reasonable attorney fees and legal costs, post-judgment interest and all further relief the court deems equitable and necessary.
